These terms of sale are entered into on one hand by the company MODE & CAFTAN France, with a share capital of 7500 euros, registered with the Registry of Commerce and Companies of AIX EN PROVENCE under number 53441345500039, hereinafter referred to as "WEDDING CAFTAN," operating the website wedding-caftan.com, and on the other hand, by any natural or legal person wishing to make a purchase via the website wedding-caftan.com, hereinafter referred to as "the buyer."
Article 1. Purpose These terms of sale aim to define the contractual relationship between WEDDING CAFTAN and the buyer, as well as the conditions applicable to any purchase made through the website tradi-caftan.fr. The acquisition of a product through this site implies an unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read before placing an order. Before any transaction, the buyer declares, on the one hand, that the purchase of products on the site tradi-caftan.fr is unrelated to their professional activity and is limited to strictly personal use, and on the other hand, that they have full legal capacity to commit to these general conditions of sale. The company WEDDING CAFTAN retains the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in effect on the date of the order by the buyer.
Article 2. Products The products offered are those listed on the website wedding-caftan.com of the company MODE ET CAFTAN, within the limits of available stocks. The company MODE ET CAFTAN reserves the right to modify the assortment of products at any time. Each product is presented on the website as a description with its main technical characteristics. The photographs are as faithful as possible but do not commit the Seller in any way. The sale of products presented on the site tradi-caftan.fr is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.
Article 3. Prices The prices listed on the product sheets in the online catalog are in Euros (€) and include all taxes (TTC), including the applicable VAT on the day of the order. Any change in the VAT rate may be reflected in the product prices. The company MODE ET CAFTAN reserves the right to modify its prices at any time, but it is understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased based on the total amount of the order. In metropolitan France, the shipping costs are 12€; for orders outside France, a flat fee for shipping expenses will be charged to the buyer in the amount of 30€ for Europe and 50 euros for the rest of the world.
Article 4. Ordering and Payment Terms Before placing an order, the buyer must create an account on the website tradi-caftan.fr. The account creation section is accessible directly from the side menu bar. Each time the buyer wishes to order or view their account (order status, profile, etc.), they must identify themselves using their information. The company MODE ET CAFTAN offers the buyer the option to order and pay for products in several steps:
Secure payment by PayPal or credit card (via the PAYPAL system): the buyer selects the products they want to order in the "cart," modifies if necessary (quantities, references...), verifies the delivery address or enters a new one. Then, the shipping costs are calculated and presented to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by PayPal." Finally, the buyer is redirected to the secure PAYPAL interface to safely enter their PayPal account or personal credit card details. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by PayPal account or credit card is irrevocable. In the event of fraudulent use of it, the buyer can demand the cancellation of the card payment; the amounts paid will then be credited or refunded. The cardholder's liability is not engaged if the disputed payment has been proven to be made fraudulently, remotely, without the physical use of the card. To obtain a refund of the fraudulent debit and any bank fees that the operation may have incurred, the cardholder must contest the charge with their bank in writing within 70 days of the transaction, or even 120 days if the contract with the bank provides for it. Article 5. Retention of Title The company MODE ET CAFTAN retains full ownership of the products sold until the full payment of the price, including principal, costs, and taxes.
Article 6. Right of Withdrawal Pursuant to Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund, with a penalty of 30 euros covering shipping, return, and conformity restoration costs for resale of the returned item.
Article 7. Delivery Deliveries are made to the address indicated on the order form, which can only be within the agreed-upon geographical area. Orders are shipped via a carrier, delivery service with tracking, without a signature. Delivery times are provided for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. The company MODE ET CAFTAN may provide the buyer with the tracking number of their package via email. The buyer is delivered to their home by their mail carrier. In case of the buyer's absence, they will receive a notice from their mail carrier, allowing them to pick up the ordered products at the nearest Post Office within a period indicated by the postal services. The risks related to the transport are borne by the buyer from the moment the items leave the premises of the company MODE ET CAFTAN. The buyer is required to check the condition of the packaging and its contents at the time of delivery in the presence of the postal worker or delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 8. Warranty All products supplied by the company MODE ET CAFTAN benefit from the legal warranty provided by articles 1641 and following of the Civil Code. In case of non-compliance of a product sold, it can be returned to the company MODE ET CAFTAN, which will take it back, exchange it, or refund it.
